3. Authorities & decisions: The Bill of Rights

Dates appearing in the associated account: 1789, 1791

Decision-makers, laws and consequences

Congress proposed twelve constitutional amendments in 1789; ten were ratified in 1791. James Madison helped draft them in response to demands for explicit restraints on federal power.

The First Amendment protected religion, expression, assembly and petition against federal abridgment. The original amendments did not immediately apply to state governments; incorporation developed much later through Fourteenth Amendment litigation.

Institutional consequences

The authorities identified above acted within institutions that determined who could govern, enforce decisions and challenge official power. The resulting changes to political participation, legal status, military control or property administration are part of the historical record of this specific event, rather than evidence that every later government followed the same path.
